Acceptance of Terms

By accessing or using Dura Lite or any other Dura Health product ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a clinic, hospital, or other organisation, you're agreeing on that organisation's behalf and confirming you have the authority to do so.

What Dura Is — and Isn't

Dura is an ambient clinical documentation tool. It transcribes consultations, generates structured clinical notes, and surfaces clinical suggestions for a licensed clinician's review.

Dura is a documentation and support tool, not a diagnostic device. It does not make clinical decisions, diagnose conditions, or prescribe treatment. Every suggestion Dura surfaces must be independently confirmed by a licensed clinician before it informs patient care. The clinician using Dura remains solely responsible for all clinical decisions made during and after a consultation.

Who Can Use Dura

Dura is intended for use by licensed healthcare providers and the clinics or facilities that employ them, in the course of legitimate clinical care. It is currently available by invitation as part of a limited pilot in Kenya.

Clinical Responsibility

Use of Dura does not transfer, reduce, or share clinical responsibility away from the treating clinician. The clinician remains fully responsible for:

  • Obtaining patient consent before any consultation is processed by Dura
  • Reviewing, editing, and confirming every note and suggestion Dura produces before it becomes part of the medical record
  • All diagnostic and treatment decisions, regardless of what Dura suggested or did not suggest

Acceptable Use

You agree not to use Dura to:

  • Process a consultation without first obtaining patient consent
  • Attempt to circumvent, disable, or interfere with Dura's consent gate or audit logging
  • Reverse-engineer, resell, or white-label the Service without written agreement from Dura Health
  • Use the Service in a way that violates the Kenya DPA or any applicable health data regulation

Service Availability

Dura is currently in active pilot. The Service is provided on an as-available basis during this stage, and we may make changes, including to features and availability, as the product develops. We'll communicate material changes to pilot participants directly.

Limitation of Liability

To the fullest extent permitted by Kenyan law, Dura Health is not liable for clinical outcomes resulting from a clinician's use of, or reliance on, Dura's suggestions — clinical judgement and responsibility remain with the treating clinician at all times. This section does not limit liability for Dura Health's own negligence in operating the Service, including in how patient data is handled and protected.

Intellectual Property

Dura Health retains all rights to the Service, including its underlying software, models, and clinical fine-tuning. Clinics and clinicians retain ownership of the clinical data generated through their use of the Service, subject to the terms of our Privacy Policy.

Termination

Either party may end participation in the pilot at any time. We'll retain or delete data on termination consistent with our Privacy Policy and applicable Kenyan health records requirements.

Governing Law

These Terms are governed by the laws of Kenya.

Changes to These Terms

We may update these Terms as the product and pilot evolve. We'll notify active pilot participants of material changes directly.
